1. Rental-Only Service / No Moving Labor

ToteDrop Joplin strictly provides the rental of reusable moving totes. We are not a moving company. Under no circumstances do we move, touch, or handle your personal belongings. Our service is limited to the delivery of empty totes to your requested drop-off location and the retrieval of empty totes from your pick-up location.

2. Service Area Limitations

We serve the Joplin, Missouri area and surrounding specific ZIP codes. Bookings made for addresses outside our approved ZIP codes may be subject to cancellation or an additional out-of-zone delivery fee at our sole discretion. We reserve the right to refuse service to locations outside of our operational boundaries.

3. Booking and Payment

Full payment for the base package rental is required to secure your reservation. Your reservation is not confirmed until payment is processed. Base prices do not include potential state or local taxes, which will be calculated at checkout.

4. Included Rental Period

Standard Residential packages include a 7-day (1-week) rental period, while Commercial packages include an extended 14-day rental period. This period begins on the calendar date the totes are delivered and ends on the calendar date the totes are scheduled for pick-up by ToteDrop Joplin.

5. Scheduled or Documented Late Returns

If you require the equipment or totes for longer than the included rental period, and you proactively reach out to us to schedule and document the extension, you will be billed a standard extended term rate. The rate is strictly an additional daily fee of 5% of package and add-ons value per day. This continues accrued daily until the totes are completely returned to ToteDrop Joplin. We reserve the right to continually charge this daily rate up to, but not exceeding, the full replacement cost of the items you are renting.

6. Customer Responsibility for Tote Care

While in your possession, you assume full responsibility for the totes. You agree to use them solely for standard residential or office moving purposes. Totes must not be used to store hazardous chemicals, paints, wet materials, or excessively messy items that cause permanent staining. Totes must be returned empty and free of excessive dirt and debris.

7. Damaged Tote Charges

Minor scuffs and scratches are expected through normal use. However, if a tote is returned with significant damage (such as being cracked, melted, permanently defaced, or otherwise rendered unusable for future rentals), you will be charged a replacement fee for that specific tote as determined by ToteDrop Joplin's replacement schedule.

8. Missing Tote / Non-Return Replacement Charges

All efforts will be made to retrieve the equipment for the following 7 days. After 7 days replacement charges are processed. If returned prior to that point, it is per ToteDrop's judgment to charge up to but not exceeding 5% of total contract value per day. Customers keeping equipment will be solely liable for formal replacement costs, strictly billed at $35.00 per missing Tote and $80.00 per missing or damaged Wheeled Tote Roller.

9. Card Authorization / Card on File

By booking with ToteDrop Joplin, you consent to keeping a valid credit or debit card on file. You expressly authorize ToteDrop Joplin to charge this card for any accumulated Extra Day Fees, Damaged Tote Charges, or Missing Tote Replacement Charges without further authorization.

10. Delivery and Pick-up Windows

We will communicate an estimated delivery and pick-up window with you prior to the date. While we strive to be punctual, these windows are estimates, and outside factors such as traffic may cause variations.

11. Access Issues

You must ensure that our delivery team has safe and clear access to your drop-off and pick-up locations. If we cannot complete a delivery or pick-up due to locked gates, loose or aggressive dogs, unsafe environmental conditions, or completely inaccessible addresses, a rescheduling fee may apply.

12. Cancellation and Rescheduling

You may cancel your reservation for a full refund up to 48 hours before your scheduled delivery date. Cancellations made within 48 hours may be subject to a nominal cancellation fee. You may reschedule your dates subject to our availability.

13. Limitation of Liability

13a. General Limitation

ToteDrop Joplin, its owners, operators, employees, agents, and independent contractors shall not be held liable for any personal injury, property damage, or loss of belongings that occur during your use of our totes or equipment. You pack, lift, stack, and transport the totes at your own risk. Our maximum aggregate liability for any and all claims relating to the service shall not exceed the total amount you paid for the rental.

13b. Assumption of Risk

By booking with ToteDrop Joplin, you expressly acknowledge and accept that the physical act of packing, lifting, carrying, and stacking loaded totes carries inherent risk of personal injury, including but not limited to back strain, muscle injury, slips, trips, and falls. You voluntarily assume all such risks. ToteDrop Joplin does not provide moving labor, does not supervise your packing or moving process, and bears no responsibility for how you choose to use, load, or transport the rented equipment.

13c. Indemnification

You agree to indemnify, defend, and hold harmless ToteDrop Joplin, its owners, officers, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with: (i) your use or misuse of the rented equipment; (ii) any breach by you of these Terms & Conditions; (iii) any injury to yourself or any third party that occurs while the equipment is in your possession; or (iv) any damage to property caused by the equipment while in your custody.

13d. Third-Party Liability

You are solely responsible for any injury, damage, or loss suffered by any third party — including but not limited to household members, guests, neighbors, movers, or bystanders — arising from the use, placement, or storage of the rented totes and equipment while in your possession. ToteDrop Joplin shall have no liability whatsoever for third-party claims regardless of cause.

13e. Property at Delivery & Pick-Up Locations

ToteDrop Joplin takes reasonable care during delivery and pick-up of equipment. However, we shall not be held liable for pre-existing conditions or minor cosmetic issues to driveways, sidewalks, lawns, landscaping, porches, door frames, walls, or flooring that may result from the normal delivery or retrieval of totes. It is your responsibility to designate a suitable, accessible delivery location free from obstructions or fragile surfaces. By confirming your delivery address, you accept this risk.

13f. Force Majeure

ToteDrop Joplin shall not be liable for any delay or failure to perform its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to: severe weather events, natural disasters, pandemics, road closures, vehicle breakdowns, acts of government, civil disturbances, or labor shortages. In such events, delivery and pick-up schedules may be adjusted without penalty, and no late return fees shall accrue during the affected period.

13g. Waiver of Consequential Damages

Under no circumstances shall ToteDrop Joplin be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: lost profits, lost time, missed real estate closings, storage costs, rental of alternative moving supplies, emotional distress, or any other damages arising from delay, interruption, or failure of service — regardless of whether ToteDrop Joplin was advised of the possibility of such damages.

14. Website / Estimate Disclaimer

The calculations shown on our website regarding cardboard box price comparisons are estimates intended for illustrative purposes. Actual local cardboard costs may vary. The website checkout calculates an estimated total; final charges may vary if extra days or damages apply.

16. Governing Law

These Terms & Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Missouri.
